These terms govern your engagement with Carroll's Painting Services. By requesting estimates, scheduling painting work, or using our website, you agree to these conditions. Please review them carefully before proceeding with any painting project.
Service Engagement
Painting services commence upon signed agreement and deposit payment. We reserve the right to decline projects that present safety concerns, require specialized equipment we don't possess, or involve surfaces unsuitable for standard painting techniques. All work follows Australian painting standards and manufacturer specifications.
Estimates and Quotes
Written estimates remain valid for 30 days from issue date. Final pricing may adjust if project scope changes or surface conditions differ significantly from initial assessment. Additional work requested during painting projects requires written approval and may incur extra charges based on materials and labor.
Payment Terms
A deposit of 30% secures your painting project scheduling. Progress payments align with completed phases, with final payment due upon satisfactory completion. We accept various payment methods with details provided in your painting contract. Late payments may incur administration fees as specified in service agreements.
Project Scheduling
We provide estimated start dates upon booking confirmation. Weather conditions, material availability, or prior project extensions may occasionally adjust painting schedules. We communicate schedule changes promptly and work to minimize disruptions to your painting timeline while maintaining quality standards.
Client Responsibilities
Clients must provide safe, accessible work areas free of hazards. Furniture and belongings should be removed from painting zones or clearly designated for protection. Necessary utilities like electricity and water must remain available. Pets should be secured away from work areas during painting operations for their safety.
Warranty and Guarantees
Our painting work carries a 3-year warranty against defects in materials and workmanship under normal conditions. This excludes damage from improper maintenance, structural issues, or environmental factors beyond our control. Warranty claims require inspection to determine cause and appropriate resolution based on findings.
Limitation of Liability
Carroll's Painting Services' liability for painting projects is limited to the contract value or cost of rectification, whichever is less. We're not liable for consequential damages, incidental losses, or pre-existing conditions discovered during painting work. Insurance covers accidental damage occurring during service provision.
Cancellation Policy
Clients may cancel scheduled painting work with 48 hours notice without penalty. Cancellations within 48 hours may incur a fee covering preparation costs. Deposits are refundable if cancellation occurs before materials procurement. Once materials are specially ordered for your project, they become non-refundable.
Dispute Resolution
Any disputes regarding painting services first undergo mediation with a mutually agreed third party. Unresolved matters may proceed to arbitration under Australian commercial arbitration rules. Legal action remains a last resort, with proceedings occurring in courts having jurisdiction over our service location.
Intellectual Property
All painting techniques, processes, and business methodologies developed by Carroll's Painting Services remain our intellectual property. Project photographs may be used for portfolio and marketing purposes unless otherwise agreed in writing. Client property details remain confidential unless disclosure is legally required.
Governing Law
These terms are governed by Australian law as applicable in our service regions. Any legal interpretations reference Australian painting industry standards and commercial practice guidelines. Both parties submit to the nonexclusive jurisdiction of courts in our primary service area for matters requiring legal resolution.
